The Law Project Goals:

The Law Project offers to its unique client population legal services which are designated to help them live more comfortably in the community. Some of our specific goals are to:

*help people obtain the most advantageous available public financial benefits.

*help people obtain the most advantageous and appropriate educational and vocational benefits.

*help clients obtain employment commensurate with their current and potential abilities.

*inform patients of their civil rights when in the hospital and in the community and to protect them in treatment-related issues.

*help people secure and maintain maximally independent decent living conditions.

*help clients acquire maximum control over their own persons, property, and affairs, consistent with their own individuals capabilities.

*help people obtain resolution of domestic relations problems.

Description of Services:

The Law Project provides SUPPORTIVE ADVOCACY for its legal clients.

We also provide OUTREACH services to hospitals and transitional programs.

The Law Project is frequently involved in PATIENTS RIGHTS ISSUES. We represent clients in issues pertaining to: medication, confidentiality of records, right to legal counsel and treatment in the least restrictive setting.

We represent clients in cases of MATRIMONIAL AND FAMILY DISPUTES, such as divorce, child custody, visitation, domestic relations problems, child placement and adoption.

The Law Project help clients who require FINANCIAL AID obtain the most advantageous benefits possible. We file appeals for clients whose Supplemental Security Income or Social Security Disability Income has been discontinued and when necessary, represent them at judicial hearings.

Clients are assisted in retaining current HOUSING or improved living conditions.

Law Project Clients have also been assisted in Small Claims Court, in matters of tenancy, consumer issues and creditor’s issues.

Who is eligible?

Services of the Law Project are available to people with legal problems who meet the following conditions:

Age: Clients must be 18 years older.

Financial Status: Pursuant to HUD guidelines.

Diagnosis: Clients must be mentally disabled, with a primary emotional disability. People are not eligible if their primary diagnosis is developmental disability, retardation, organic brain syndrome or chronic substance abuse.

History: Client has been engaged in mental health treatment for many years.

Function Level: Client must require substantial assistance in social skills, vocational or educational guidance and community living.

Residence: Clients may be living either in the community or in a hospital and must be residents of Bergen County.

What is the LAW Project?

The Bergen County Mental Health Law Project is one the community resources designed to help previously hospitalized people make a successful transition to independent living. We are the only agency in the county which addresses the legal needs the chronically mentally ill.

We provide free legal services to eligible clients who are involved in civil clients who are involved in civil matters. As a service funded by the County and the State of New Jersey, we accept only people who are unable to pay for private counsel.

Since 1977, we have represented thousands of clients in such matters as matrimonial or child custody disputes and at Social Security hearings. Our staff of attorneys and a psychiatric social worker provides specialized legal services and supportive advocacy as well as counseling and outreach.

The Law Project accepts referrals from the public and private mental health network, from Legal Services and from private attorneys.

We are pleased you have chosen to ride NJ Transit. This brochure provides a brief description of the accessible services available to people with disabilities and senior citizens. For more information, please contact NJ Transit or visit http://www.NJTRANSIT.com. Services include accessible rail and light rail  vehicles, lift-equipped and kneeling buses, Access Link ADA paratransit, the Reduced Fare Program, transit information in accessible formats and more. We encourage you to take advantage of these services and allow NJ Transit to be “The Way to Go.”

Accessible Rail:

Many NJ TRANSIT’s rail stations are accessible by elevator, ramp, mini high-level platform or portable lift. Before a passenger using a mobility device boards the train, the passenger should inform the train crew of their destination.

Accessibility Features:

*Bridge plates are available at all high and mini high-level platforms to bridge the gap between the platform and the train.

Accessible Light Rail:

NJ TRANSIT operates three light rail systems, the Hudson-Bergen Light Rail, the Newark City Subway and the River line. Most of the light rail stations served by NJ TRANSIT are accessible. Platforms are accessible by elevator or ramp. Most light rail stations do not have ticket agents, so you will need to buy a ticket from a Ticket Vending Machine (TVM) and validate it.

Accessible Bus:

NJ TRANSIT provides lift-equipped buses, which are marked with the international symbol of accessibility. It’s required that your mobility device be secured. You may make a reservation for a lift-equipped bus but it is not required.

1. For accessible transportation information.
2. To reserve a lift-equipped bus for travel into or out of the Port Authority Bus Terminal or George Washington Bridge Bus Terminal.

Accessibility Features:

*All of NJ TRANSIT buses are equipped with a kneeling feature. This is for people who have difficulty with the first step up into the bus. When a bus “kneels” the first step lowers several inches to the ground.

*Internal announcements are made at transfer points, major intersections, final destinations and any stop requested by a passenger.

Reduced Fare Program:

People with disabilities and senior citizens age 62 and above may take advantage of the reduced fare at any time on buses, light rail and trains.

*People with disabilities must present a NJ TRANSIT Reduced Fare Card or Medicare Care to obtain the reduced fare.

*Senior Citizens over the age of 62 can produce any form of ID that verifies their date of birth.

Access Link:

Access Link is a public transportation service developed to comply with the paratransit regulations of the ADA. Access Link service is comparable to the local fixed route bus and light rail systems. Access Link is for people with disabilities who are unable to use the local fixed route bus. In order to use Access Link, you must first apply for an in person eligibility assessment.

Community Paratransit services provide flexible transportation options to people with disabilities and senior citizens in all 21 counties. Community Paratransit providers use lift equipped vans and minibuses and may operate modified fixed route, curb to curb, door to door or advance reservations.

What is GO?

Global Options for Long-Term Care (GO) is a Medicaid Waiver program for eligible seniors and adults with physical disabilities who are at risk of placement in a nursing facility but wish to receive services in the community. It can also help people currently in nursing facilities move back to the community.

GO is designed to supplement the assistance already being provided by family, friends and neighbors. GO strengthens the ability of caregivers to continue in their vital role as primary support providers.

GO participants work with a care manager to create an individualized plan of care based on a comprehensive assessment of the participants healthcare needs. Once the plan of care is approved, community-based services are put in place and monitored to ensure quality and effectiveness. In certain cases, GO participants may hire their own employees.

Who is Eligible for GO?

To be eligible to participate in GO, you must be a New Jersey resident who:

*Is age 65 and older or age 21 to 64 and determined disabled* by the US Social Security Administration or the NJ Division of Medical Assistance & Health Services.
*Is a US Citizen or a qualified alien.
*Require (or will require within 30 days) the level of care traditionally given in a nursing facility but wishes to remain at home.
*Meets the program’s financial eligibility criteria for Medicaid.
*Has no alternate means to obtain the needed support.

**Individuals between the ages of 21 and 64 who are chronically mentally ill, mentally retarted or developmentally disabled may be eligible after a service need review by the DHSS/DHS Service Review Team.

The Bergen County Sheriff’s Office is proud to participate in Project Lifesaver International, which helps provide rapid response to save lives and reduce the potential for serious injury for adults and children who wander due to Alzheimer’s, Autism, Down Syndrome, Dementia and other related orders.

Project Lifesaver has more than 1,100 participating agencies across the U.S., Canada and Australia and is implemented in every county in New Jersey by local Sheriff’s offices. As the lead agency in Bergen County, the BCSO is trained and equipped to deploy members of the Sheriff’s Office to assist local police agencies in locating individuals who may wander from home and become lost due to confusion and memory loss.

How Project Livesaver Works:

Participants in the program are fitted with a one-ounce battery operated radio wrist transmitter that emits a silent tracking signal every second, 24 hours a day. The signal can be tracked on the ground or in the air from several miles.

Each wristband has a unique frequency, so the BCSO’s Project Lifesaver team can positively locate and identify a person who has wandered away from home using a specially designed radio receiver.

If a participant wanders off, the caregiver would first contact his or her local police , who would then initiate a search while contacting the Sheriff’s Office. A team of specially trained officers from the Sheriff’s Office would respond and search, utilizing the electronic tracking equipment.

The team is trained in methods necessary to communicate with a person who has Alzheimer’s Autism Down Syndrome or a related disorder. The team knows how to approach a disoriented person, gain their trust and put them at ease for the trip home.

Project Lifesaver was established in 1999 by the Chesapeake, Virginia, Sheriff’s Office. The program has rescued more than 2,143 people in the last 10 years with a 100 percent success rate. In areas where the system has been used, search times have been greatly reduced, which can mean the difference between life and death. The average rescue is less than 20 minutes and the program has saved many hundreds of hours of search time and public resources.

If you are a caregiver of an individual with Alzheimer’s, Autism, Down Syndrome or a related disorder and are interested in applying for Project Lifesaver:

*Please call the BCSO’s Community Outreach Unit at (201) 336-3540 to request an application.

Participation Criteria:

*Participants must be diagnosed with Alzheimer’s, Autism, Down Syndrome, Dementia or a related disorder.
*Participants must live in Bergen County in a private residence with a 24-hour, live in caregiver.
*There is a one-time equipment fee of $300 for the wrist transmitter, band, battery, clips and battery tester. Income-eligible participants may qualify for a waiver of the initial equipment fee.
*A monthly maintenance fee of $13 covers the cost of the bracelet and battery.
*The wrist transmitter remains the property of the Bergen County Sheriff’s Office. Once the individual is no longer utilizing the unit, it is returned and reassigned to another participant in the program.
*An officer from the Sheriff’s Office will schedule an appointment to attach the wristband unit and train a caregiver in how the equipment works.

Post Stroke & Disabled Adult Support Groups

Policy Statement and Standards of Program Eligibility

Goal: To maintain and provide a quality level of support and activity to all eligible Bergen County Stroke survivors and adults with a disability.

Objective: To continue to expand groups by providing outreach to Bergen County Stroke survivors and adults with a disability to attend one of the support groups and maintain a safe and friendly, supportive environment as well as screen all potential support group participants and complete program intake forms to determine eligibility or non-eligibility.

Application Process: All adults with disabilities interested in becoming a support group member must complete an intake/application form. This form contains participant information such as name, address, phone, medical information , medications, current therapies (Speech, Physical, Occupational), special needs, use of durable equipment (i.e. wheelchair, quad cane, walker) emergency contact and request for transportation. There is no waiting list for participation.

1. The Bergen County Division on Disability’s (DDS) Post Stroke & Disabled Adult Support Groups receive referrals from various County and local agencies, hospitals and service organizations. Client referrals and families with minority adult family members are often referred to our support groups for information and participation.

2. It is the policy and mission of the Post Stroke & Disabled Adult Support Group Programs to accept any individual, regardless of that person’s disability, who meets the minimum standards for participation.

3. Standards of Eligibility:

*Participants must comply with socially acceptable norms and maintain appropriate behavior in the support group.

*Maintain good personal hygiene

*Able to provide for personal needs such as toileting and feeding oneself or is accompanied by a companion or aide to provide assistance.

4. Standards of Non-Eligibility

*Incontinence, wandering, disruptive behavior

While there are no formal termination procedures for participants of the Post Stroke & Disabled Adult Support Group Program, the refusal or inability of a client to cooperate with program eligibility guidelines; physically abusive behavior that may endanger oneself or others and obscene/abusive language or behavior, will not be tolerated and referrals to other adult programs may be initiated. Further there is no appeals process for participations of the Post Stroke & Disabled Support Group Program since determination made by the County in this regard are discretionary.

*Chore is unable to service emergencies and does not do outdoor work, painting, tiling, door or window replacements, work requiring high ladders, heavy lifting, new wiring or appliance repairs.

*No cosmetic repairs or interior decorating
*Repairs for apartment dwellers are limited to personal items only.
